Those that would like that position often characterize the position as the best job in the field because a Prosecutor is the person responsible for investigating, pressing charges against a suspect, prosecuting the defendant and then making a sentencing recommendation. Just by this short list you can see that a Prosecutor has a significant impact on the liberty and life of a defendant. Because of these duties and responsibilities Prosecutors are under intense pressure to bring a person to trial and successfully prosecute the person. In fact, it is well known that Prosecutors who do not win every case are not Prosecutors for long.
For this discussion you are an Assistant District Attorney and have been assigned to prosecute a person for sexually abusing children, and murdered at least one. At first glance the investigation developed sufficient evidence to support the belief that this case is a “slam dunk.” Winning the case would significantly enhance your chances of becoming a District Attorney, if not a higher position in the State government.
As you are going through the evidence you suspect that one of the Detectives may have fabricated some evidence. You talk to the Detective and he denied fabricating the evidence. You are not convinced, in fact you are so concerned that you decide not to call this Detective as a witness, you decide to call another Detective. You also decide not to advise the Defense Counsel or the Judge.
You based your decision on your belief that the evidence is not crucial, and that you need to win this case because the defendant is a threat to society.
